Christy at firedoglake says it is really not good practice for a client's lawyers to piss off the judge. Team Libby is losing credibility with Judge Walton. First, Libby's attorneys tried to cirumvent Walton's previous rulings on introduction of classified material, and they appeared to be setting the stage to use the "memory defense" without troubling Libby to actually testify himself. Walton ruled "No Libby testimony, no memory defense." Then they made a big fuss about not having legible copies of documents from Cathie Martin (which Fitz disputed) - but had waited for over a year until just this past Saturday to request access to the originals, and claimed the wait was due to being overwhelmed by too many documents.
